The Rules
of Intestacy

The Rules of Intestacy can be quite confusing so the Intestacy flow chart should make it a little clearer!

Who inherits property if no will?

 

If there is no Will, generally, only spouses, civil partners and blood relatives inherit under intestate succession laws; unmarried partners, friends, and charities get nothing. If the deceased person was married, the surviving spouse usually gets the largest share.

 

Can you challenge intestacy rules?

 

You can only challenge an inheritance under a will or intestacy if you meet the following criteria:

 

  • You have to come within the class of people allowed to challenge; and;
  •  You have to prove the will or intestacy failed to make you reasonable financial provision;
  • The application must be made within 6 months of probate.
